1. INTRODUCTION

Welcome to WebComica ("we", "our", and "us"). By accessing or using our website and mobile application (collectively, the "Service"), you agree to comply with and be bound by this User Agreement ("Agreement"). Please read this Agreement carefully. If you do not agree with these terms, you should not use our Service.

2. ELIGIBILITY

By using the Service, you represent and warrant that you have the consent of a parent or guardian to use the Service if you are under 18.

3. 3.ACCOUNT REGISTRATION

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. SUBSCRIPTION AND PURCHASES

WebComica provides users with both free and premium features, where access to premium content requires a subscription that can be billed weekly, monthly, or annually. Payments for these subscriptions are managed through third-party services such as the Apple iTunes Store, Google Play Store, or Stripe. Subscriptions will automatically renew unless you cancel them before the next billing date. To avoid being charged for the subsequent billing cycle, you need to follow the cancellation procedure specific to your platform: on Android, go to the Google Play Store app, tap your profile icon, then navigate to "Payments & subscriptions," select "Subscriptions," and cancel the desired subscription; on Apple/iOS, open the "Settings" app, tap your name, go to "Subscriptions," locate the subscription you wish to cancel and select "Cancel Subscription." Please remember that subscription fees are non-refundable.

5. USER CONTENT

  1. 1) Our Service allows you to post and share various types of content, including comics, images, GIFs, text, scripts, graphics, photos, sounds, audiovisual elements, links, user comments, and other materials ("Content"). By submitting Content, you grant WebComica a perpetual, non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, publicly display, copy, and distribute your Content on and through the Service, as well as for promotional, advertising, and marketing purposes on other platforms and social media channels.
  2. 2) WebComica is not responsible for user-generated content on the Service. You are solely liable for all Content you post and for all activities conducted under your account, whether by you or by others using your account. By submitting Content, you represent and warrant that you hold all necessary rights to the Content or have obtained the necessary permissions to grant the specified licenses. Additionally, you affirm that your Content does not infringe on any third-party rights, including but not limited to privacy rights, publicity rights, copyright, or contractual rights, and does not contain any illegal, offensive, disturbing, obscene, threatening, defamatory, or otherwise objectionable material.
  3. 3) We reserve the right, but are not obligated, to determine the appropriateness of Content and to refuse or remove any Content at our sole discretion. This includes the right to edit, format, or alter Content and to limit or revoke access to the Service if objectionable Content is posted. As we cannot control all user-generated or third-party Content, you use the Service at your own risk and understand that you may encounter material that you find offensive or objectionable. We are not liable for any Content, including any errors or omissions, or for any resulting loss or damage. Additionally, although we perform regular backups, we do not guarantee against data loss or corruption and have no liability for issues related to Content integrity or failure to restore Content. You are responsible for maintaining a complete and accurate copy of your Content independent of the Service.

6. PRIHIBITED MATTERS

You must not use the Service in any way that could harm WebComica, its affiliates, or any third party, interfere with the Service, or violate any laws. Specifically, you are prohibited from:

  1. 1) Impersonating others or misrepresenting your affiliation.
  2. 2) Allowing others to use your account.
  3. 3) Unauthorized content scraping or harvesting of personal information.
  4. 4) Overloading WebComica’s network or infrastructure.
  5. 5) Interfering with the Service’s operation or attempting to breach security.
  6. 6) Reverse-engineering any service software.
  7. 7) Distributing unauthorized materials or spam without WebComica’s permission.
  8. 8) Conducting activities that restrict others' use of the Service or expose WebComica to liability.

7. COPYRIGHT POLICY

We are dedicated to protecting intellectual property rights. If you think that any content on our Service infringes your copyright, please contact our designated copyright agent at contact@webcomics.fun . Include a detailed description of the alleged infringement. Upon receipt of your notice, we will review the claim and may take appropriate action, including removing the content if warranted. Be aware that submitting false claims may result in liability for damages, costs, and legal fees. To submit a DMCA notice, please provide our copyright agent with the following written information:

  1. 1) The signature of the person authorized to act on behalf of the copyright owner.
  2. 2) A description of the work that you believe has been infringed, including its location on our Service.
  3. 3) Your contact information.
  4. 4) A statement affirming your belief that the use of the content is unauthorized.
  5. 5) A declaration, made under penalty of perjury, affirming that the information in your notice is accurate.

8. PRIVACY

Please review our Privacy Policy, which governs the use of personal information in the Service and to which you agree to be bound as a user of the Service.

9. DISCLAIMERS AND LIMITATION ON LIABILITY

  1. 1) Your use and browsing of the Service is at your risk. If you are dissatisfied with anything contained in the Service, or with and of this Agreement, your sole and exclusive remedy is to discontinue accessing and using the Service.
  2. 2) WebComica assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or member communications. WebComica is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Service or combination thereof, including injury or damage to users and/or members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Internet and/or in connection with the Service. Under no circumstances will WebComica be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Service, or any interactions between users of the Service, whether online or offline. WebComica cannot guarantee and does not promise any specific results from use of the Service.
  3. 3) TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, NEITHER WEBCOMICA NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SERVICE SHALL BE LIABLE TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS ARISING OUT OF YOUR ACCESS TO, OR USE OF, THE SERVICE, LOSS OF DATA, LOSS OF OTHER INTANGIBLES, LOSS OF SECURITY OF INFORMATION YOU HAVE PROVIDED IN CONNECTION WITH YOUR USE OF THE SERVICE, OR UNAUTHORIZED INTERCEPTION OF ANY SUCH INFORMATION BY THIRD PARTIES, EVEN IF WEBCOMICA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SERVICE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. THE MAXIMUM LIABILITY TO WEBCOMICA FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE) OR OTHERWISE, SHALL BE THE TOTAL AMOUNT PAID BY YOU, IF ANY, TO ACCESS THE SERVICE.

10. MISCELLANEOUS

  1. 1) Governing Law: The laws of Hong Kong will govern and be construed in conformity with this Agreement. Any disputes arising out of or in connection with this Agreement shall be resolved by arbitration in Hong Kong, which shall be conducted in accordance with the rules of the Hong Kong International Arbitration Centre (HKIAC).

  3. 3) Survival: If any element of this Agreement is found to be invalid, unlawful, or unenforceable, the remaining sections will continue to be valid, legal, and enforceable in full force and effect.
  4. 4) Change and Assignment: We reserve the right to modify this Agreement at any time. Any changes will be effective when we post the revised Agreement on the Service. Your continued use of the Service after such changes constitutes your acceptance of the modified Agreement. We also may assign its rights and obligations under this Agreement, in whole or in part, to any person or entity at any time without notice to you. You may not assign this Agreement without our prior written consent.
